The term can extend to certain practices that are calculated to trade on the reputation of others, or to falsely advertise products and services in a way that creates an unfair competitive advantage. Unfair competition cases and statutes are evolving to cover a vast array of business conduct. “Unfair competition” is a term that identifies rights under both Federal and State laws. It is not uncommon to see an intellectual property lawsuit for trademark rights, that also adds claims for unfair competition under these state and federal laws.
